Bayer’s stock has morphed into something far removed from a conventional DAX heavyweight over the past few weeks. With an annualised 30-day volatility above 61 percent, the shares now trade more like a binary option on litigation outcomes than a life-science conglomerate. That dynamic has been on full display since the U.S. Supreme Court ruled 7-2 in the company’s favour in late June, ending a years-long legal overhang that had suppressed the share price.
The court’s decision, handed down on 3 July, held that Missouri state law cannot override the uniform labelling requirements set by the Environmental Protection Agency for glyphosate-based products such as Roundup. For Bayer, which inherited the Monsanto litigation through its $63 billion acquisition in 2018, the ruling punched a hole in the vast majority of warning-label claims. The stock reacted immediately, reaching a new 52-week high of €53.86 on the same day. Since then it has cooled slightly, closing Friday at €50.18, down 1.03 percent on the session. Even at that level, the 12-month gain stands at a staggering 80.99 percent, and the price has more than doubled from its August 2025 trough of €25.09.
Yet the rally has been compressed into an unusually short window. Over the past 30 days alone, the stock has surged 42.60 percent. The year-to-date advance now amounts to 31.97 percent. That kind of velocity has pushed the shares deep into overbought territory. The 14-day relative strength index sits at 70.4, and the gap to the 50-day moving average of €40.16 has widened to nearly 25 percent. The distance from the 200-day average of €37.68 is even more stretched at 33.18 percent. These are levels that, even for a genuine turnaround story, rarely persist without a pullback or consolidation.
And indeed, a consolidation appears to have begun. The stock lost 5.39 percent in the past seven trading days, a reminder that binary-event rallies can reverse just as sharply as they erupt. The technical indicators suggest the market has priced in a degree of legal clarity that may not yet be fully warranted.
Should investors sell immediately? Or is it worth buying Bayer?
Bayer’s legal picture remains incomplete. On the federal level, roughly 4,000 cases are still pending — although Bayer itself puts the figure at about 200, citing unrefreshed court data. A federal judge in San Francisco, Vincent Chhabria, is overseeing the next procedural steps and has already raised concerns about the proposed $7.25 billion settlement that the company hopes will resolve the bulk of remaining claims. That settlement, which would cover Roundup users outside Missouri and individuals without a cancer diagnosis, is scheduled for a hearing in August.
Beyond the federal forum, more than 60,000 similar lawsuits are grinding through state courts. The Supreme Court decision is not expected to affect those proceedings, leaving Bayer exposed to a separate, sprawling litigation track. The company continues to pursue a settlement framework of up to $7.25 billion for that tranche as well.
With a market capitalisation of €49.81 billion, the stock has already received a significant vote of confidence from investors. But the combination of a drastically overbought chart, a binary legal calendar, and a still-unresolved state-level exposure creates a delicate balance. Every piece of favourable news has been amplified; any setback — from Judge Chhabria’s assessment of the settlement to an adverse state court ruling — could hit a stock that currently has very little technical cushion left.
